Welcome to Neibra. These Terms of Use ("Terms") are a binding agreement between you and Neibra ("Neibra", "we", "us", "our") and govern your use of the Neibra mobile application, the website at neibra.app and related services (together, the "Service"). Please read them carefully. By creating an account, or by accessing or using the Service, you confirm that you have read, understood and accept these Terms, our Privacy Policy and our Rental Rules.
1. About Neibra
Neibra is a platform that helps neighbours in Israel lend and borrow everyday items. Users who offer items ("Owners") publish listings; users who want to borrow an item ("Renters") can find listings nearby, talk to the Owner in chat, and request the item for specific dates. In these Terms, a "rental" means an agreement to lend an item for agreed dates through the Service. During the current launch phase, every rental is a free loan: no rental fees, deposits or other payments are involved (see section 6).
Neibra provides the technology that connects Owners and Renters. Neibra is not a party to any rental agreement between users. We do not own, possess, inspect, store, deliver or control any of the items listed, and we do not act as an agent, broker, insurer or representative of any user. Each rental is an agreement directly between the Owner and the Renter.
2. Eligibility and accounts
- Age. You must be at least 18 years old to use the Service. We ask for your date of birth when you set up your account. If you are under 18, do not use the Service.
- Account. You sign up with an email address and a password. You agree to provide accurate information (including your name and date of birth) and to keep it up to date. A profile photo is optional; if you add one, it must be a genuine picture of you and must not infringe anyone's rights.
- One person, one account. Accounts are personal. You may not create an account for someone else, impersonate another person, or create multiple accounts to get around restrictions, blocks or limits.
- Security. You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly at hello@neibra.app if you believe your account has been compromised.
3. Phone verification
To publish a listing, request a rental or join a community, you must verify a mobile phone number by entering a one-time code that we send to you by SMS. You may only verify a phone number that belongs to you and that you are entitled to use. Verification confirms that you control a phone number; it is not an identity check, a background check or an endorsement of any user by Neibra.
4. Listings
If you publish a listing, you represent and warrant that:
- you own the item, or are otherwise legally entitled to lend it, and doing so does not breach any agreement, lease or law;
- the listing (title, category, description, photos and availability) is accurate, complete and not misleading, and the photos show the actual item;
- the item is safe, in working order when used as intended, lawful to possess and lend in Israel, and not a prohibited item under these Terms or the Rental Rules;
- you will disclose any defects, limitations, safety instructions or special conditions that a reasonable Renter would want to know.
During the launch phase, listings are free to borrow and must not state a price, fee or deposit. Please list everyday items of modest value, as described in the Rental Rules.
Moderation. Item photos are automatically screened for inappropriate content before a listing is published, and listings may also be reviewed by us. We may decline, hide, edit the categorisation of, or remove any listing at our discretion, including where we believe it breaches these Terms or the Rental Rules. Automated screening is not perfect, and the fact that a listing appears on Neibra does not mean we have checked or approved the item.
5. Requests, rentals and handovers
- Requests. A Renter requests specific dates for an item through the chat. The Owner decides whether to accept or decline each request. No rental exists until the Owner accepts.
- The rental agreement. When an Owner accepts a request, a rental agreement is formed directly between the Owner and the Renter on the terms shown in the listing and agreed in the chat, together with the Rental Rules. Neibra is not a party to that agreement.
- Handover and return. At pickup and at return, both users confirm the condition of the item in the app and close the handover with a short confirmation code. These confirmations are a record made by the users themselves; Neibra does not verify them.
- Renter's duties. The Renter must use the item carefully and only for its intended purpose, follow the Owner's instructions, not sub-rent or lend it to anyone else, and return it on time, clean and in the same condition as received, apart from normal wear and tear.
- Owner's duties. The Owner must make the item available as agreed, in the condition described, and must act fairly and honestly when confirming its condition at return.
- Cancellations. Either user may cancel a rental in accordance with the Rental Rules. Repeated late cancellations or no-shows may lead to restrictions on your account.
6. Free lending during launch
Lending on Neibra is free. During the current launch phase, Neibra does not offer paid rentals, rental fees, deposits or any other payments, and no money is taken, held or transferred through the Service.
- Don't ask for money. Owners must not ask for, accept or require any payment, rental fee or deposit for an item listed on Neibra, whether in chat, at the handover or outside the Service. Renters must not offer one as a condition of borrowing.
- No arrangements around Neibra. Using Neibra to find a borrower or an item and then arranging a paid rental or deposit outside the Service is not allowed during the launch phase.
- Neibra charges no fees. Using the Service is free of charge.
- Future paid features. We may introduce paid rentals, deposits or other paid features in the future. If we do, we will announce the change in advance, update these Terms, and ask for your agreement to the updated Terms before those features apply to you.
7. Communities
Users can create closed communities (for example, for a building or a street). You can join a community only with an invite code issued by its owner or an admin, and only after verifying your phone number. You may belong to up to three communities at a time.
- Members of a community can see each other's names within that community.
- Community owners and admins are responsible for how they share invite codes and manage membership. They are users like anyone else and do not act on behalf of Neibra.
- Membership in a community does not mean that Neibra, or the community owner, vouches for any member.
8. Chat, reviews and your content
You can message other users about a listing or a rental. Keep conversations relevant, respectful and lawful. You may hide a conversation for yourself, block a conversation, and report messages, listings or users to us.
After a completed rental, both users can rate and review each other. Reviews are published at the same time, or when the review window closes, so that neither side can react to the other's review first. Reviews must be honest, based on your own experience of that rental, and must comply with the Rental Rules. We may remove reviews that breach these Terms but we do not edit the substance of genuine reviews.
Your content. You keep ownership of the content you submit (listings, photos, messages, reviews, profile information). You grant Neibra a non-exclusive, worldwide, royalty-free, transferable licence to host, store, reproduce, display, adapt (for example, resize or compress images) and distribute that content, solely to operate, secure, improve and promote the Service, for as long as the content is on the Service and for a reasonable period afterwards as needed for backups, legal and safety purposes. You confirm that you have all rights needed to grant this licence and that your content does not infringe anyone's rights.
9. Prohibited items and conduct
You may not list, request or borrow:
- weapons, firearms, ammunition, explosives or parts of them;
- drugs, controlled substances or related paraphernalia, and prescription medicines;
- alcohol or tobacco products offered to anyone under 18;
- stolen, counterfeit or pirated goods;
- hazardous materials (for example, flammable gases, toxic chemicals or pesticides);
- live animals;
- motor vehicles;
- medical devices that require a prescription or professional supervision;
- adult or sexually explicit content or items;
- items you do not own or are not allowed to lend, and any item whose possession, lending or use is illegal.
You also may not:
- harass, threaten, abuse, stalk or discriminate against any person, including on the basis of religion, ethnicity, nationality, gender, sexual orientation, disability or age;
- commit or attempt fraud, including moving an arrangement off the platform to deceive another user;
- ask for, offer or take any payment, fee or deposit for an item listed on Neibra during the launch phase;
- post fake, paid-for, retaliatory or misleading reviews, or manipulate ratings;
- use contact with other users for any purpose unrelated to a listing or rental, including advertising, spam, dating or recruitment;
- collect other users' personal data, scrape the Service, or use bots or automated tools to access it;
- interfere with, reverse engineer, probe or disrupt the Service or its security;
- use the Service in breach of any law.
10. Safety and the limits of our role
Neibra does not inspect, test, certify or insure any item, and does not verify users' identities or backgrounds. We do not guarantee the quality, condition, safety, legality or fitness for purpose of any item, the truth or accuracy of any listing, profile or review, or the ability of any user to complete a rental. Neibra does not provide insurance, and items are not insured by us while lent.
You are responsible for your own decisions and safety when dealing with other users, including when meeting in person. Please follow the safety tips in the Rental Rules.
11. Disputes between users
Any disagreement about a rental, including late returns, damage or loss, is between the Owner and the Renter. We encourage users to resolve issues respectfully in chat, relying on the condition confirmations made at handover and return. We may, at our discretion, look into reports and take action on accounts, but we are not obliged to mediate or decide disputes and we are not liable for their outcome.
12. Reports, suspension and termination
You can report content or users in the app or by email. We may investigate reports and, where we reasonably believe that you have breached these Terms, the Rental Rules or the law, or that your use puts others at risk, we may remove content, limit features, suspend or close your account, with or without notice where appropriate. Where reasonable, we will tell you why and give you an opportunity to respond by writing to hello@neibra.app.
You may stop using the Service at any time and may delete your account in the app under Settings → Delete account, or by emailing hello@neibra.app, as described in the Privacy Policy. An account with an active rental cannot be deleted until that rental is finished or cancelled. If your account is suspended or blocked, the in-app option is not available — to delete it, email hello@neibra.app from the address linked to your account and we will process the request. Completed rental records and reviews may be kept in anonymised form (shown as "Deleted user"). Obligations relating to rentals already agreed, and sections of these Terms that by their nature should survive (including licences for backups, disclaimers, limitation of liability, indemnity and governing law), continue after your account is closed.
13. Neibra's intellectual property
The Service, including its software, design, logo, name and content provided by us, is owned by Neibra or its licensors and is protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, solely to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell or create derivative works from any part of the Service except as allowed by law.
The app uses map data and tiles from OpenStreetMap, © OpenStreetMap contributors, and other open-source components licensed under their own terms.
14. Third-party services and app stores
The Service relies on third-party services such as cloud hosting, push notifications, SMS delivery and map tiles. No payment provider is used during the free launch phase. Your use of app stores (such as the Apple App Store or Google Play) is governed by their own terms. Apple and Google are not parties to these Terms and have no responsibility for the Service.
15. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure, that item locations shown on the map are exact, or that any content is accurate. Nothing in these Terms limits any right you have under mandatory consumer protection law.
16. Limitation of liability
To the fullest extent permitted by law:
- Neibra is not liable for any loss, damage, injury or claim arising out of a rental or any interaction between users, including damage to, loss of, or defects in any item, or any personal injury or property damage caused by an item;
- Neibra is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill;
- Neibra's total liability to you for all claims relating to the Service is limited to the greater of the fees you paid to Neibra (if any) in the twelve months before the claim arose, or 100 ILS.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or for death or personal injury caused by our negligence.
17. Indemnity
You agree to indemnify and hold Neibra harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your content, your listings or rentals, your breach of these Terms or the Rental Rules, or your violation of any law or third-party right.
18. Changes to the Service and these Terms
We may change the Service, and we may update these Terms from time to time. When we make material changes, we will notify you in the app or by email before they take effect and may ask you to accept the new version. The app records which version of each document you have accepted and when. If you do not agree to the updated Terms, you must stop using the Service; continued use after the effective date means you accept them.
19. Governing law and jurisdiction
These Terms and any dispute relating to them or to the Service are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts in Tel Aviv-Jaffa have exclusive jurisdiction, except where mandatory law gives you the right to bring proceedings elsewhere.
20. General
These Terms, together with the Privacy Policy and the Rental Rules, are the entire agreement between you and Neibra about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a reorganisation, merger or sale of the Service. These Terms are written in English; if we provide a translation, the English version prevails to the extent permitted by law.
